Status of Commissions for SCs

This study reviews the status of the constitution, composition and functioning of the State Commissions for Scheduled Castes (SC) and provides a set of recommendations in order to make the Scheduled Castes Commissions more vibrant, responsive and accountable. This was a part of a larger study on functioning of Statutory Commissions mandated for the socially excluded groups (Commission for Scheduled Castes, Scheduled Tribe, Women, Minorities and Persons with Disabilities) initiated by PACS and carried out by Participatory Research in Asia (PRIA).

The Constitution of India makes clear and strong commitments to overcome the entrenched socio-economic exploitation of Scheduled Castes and to provide them with social justice. Special provisions are made to address historical discriminations and to improve the socio-economic status of the SC community in the country. In order to further address the issues of social justice and socio-economic development of the SC community, parliament legislated to create a National Commission on Scheduled Castes and Scheduled Tribes in 1990 through the 65th constitutional amendment. Consequent to this enactment, several state legislatures have also enacted a conformity legislation to create State SC Commissions since then.

This report analyses the functioning and impacts of 3 such State SC Commissions based on empirical studies and consultations carried out in Bihar, Madhya Pradesh (MP) and Uttar Pradesh (UP) from July 2013 - February 2014. It describes the nature of the mandates of these Commissions, the experiences of members of the SC community with regards to their functioning, and identifies factors that have influenced their performance. It also makes suggestions for making SC Commissions more vibrant, responsive and accountable to their mandates and to the SC community in the country.

This was a part of a larger study of five different Statutory Commissions mandated for the socially excluded groups (Commission for Scheduled Castes, Scheduled Tribe, Women, Minorities and Persons with Disabilities).
